MPAQ Events Terms and Conditions

All tickets to Master Plumbers' Association of Queensland (MPAQ) events are issued subject to these terms and conditions. By purchasing MPAQ tickets and/or attending MPAQ events, you are agreeing to abide by these terms and conditions.

These terms and conditions are subject to, and will not apply to the extent that they exclude, restrict or modify your rights (including any consumer guarantees) under the Australian Consumer Law (Non-excludable Consumer Obligations). Any rights and remedies given to consumers under these terms and conditions are in addition to the rights and remedies provided under the Australian Consumer Law. 

Booking applications will be treated as confirmed upon receipt of a registration form and issuance of a tax invoice/receipt/confirmation letter. Payment is to be received within 28 days of invoice or no later than two weeks prior to the event, whichever is the earlier.

MPAQ Event Terms and Conditions

  • Cancellation Policy

    In organising such events MPAQ has committed to contracts with venues and/or service providers under which payment falls due, within certain timeframes, by virtue of the attendee's purchase of a ticket and remain payable regardless of the attendee's non-attendance. MPAQ's cancellation policy accordingly reflects its obligations under those various contracts, insofar as it is possible to do so in a general policy. 

    If a registered attendee cancels or does not attend the MPAQ event other than for a reason that relates to the Non-excludable Consumer Obligations, or the Force Majeure policy, for example where the registered attendee cancels or does not attend due to a change in the registered attendee's own circumstances, the following general policy applies: 

    • A full refund will be provided for all cancellations received in writing at least 30 days prior to the event. 
    • No refund will be given for any cancellations received after this period, or for non-attendance on the day. 
    • Attendee substitutions may be made at any time subject to the communication to, and approval by, MPAQ (which cannot be unreasonably withheld). 

    Individual Assessment

    If you are not satisfied with any MPAQ refund pursuant to the above policy, you are welcome to approach MPAQ for an assessment of MPAQ's particular losses incurred due to your non-attendance of an event. An individual assessment may result in:

    • a lower refund than would be payable under the general policy, if the losses incurred by MPAQ due to your non-attendance are higher in your particular case;
    • a greater refund than would be payable under the general policy, if the losses incurred by MPAQ due to your non-attendance are lower in your particular case (for example, where the event is conducted online with unlimited capacity and your cancellation does not impact upon the venue, service provider or MPAQ's ability to resell the tickets); or
    • confirmation that a refund as per the general policy is appropriate in your particular case. 

    Noting that, the maximum losses incurred under an individual assessment will not exceed 100% of the value of your ticket. 

    Cancellation by MPAQ

    Subject to the Force Majeure policy below, in the event that an MPAQ event is cancelled and provided that the event is cancelled more than 30 days prior, MPAQ will contact registered attendees to offer either: 

    • an alternative event on an alternative date; or 
    • a full refund of the event fee. 

    Force Majeure Policy

    Except in relation to the COVID-19 Border Closure policy, neither party shall be liable to the extent if failure to perform (or if delay in performance of) any of its obligations under these terms and conditions is a result of a Force Majeure Event, provided that the party suffering such delay immediately notifies the other party of the delay.

    A 'Force Majeure Event' means any cause, event or circumstance whatsoever outside the reasonable control of a party including, but not limited to, health pandemics, war, strikes, lockouts, industrial disputes or unrest, accidents to machinery, restrictions or intervention imposed by any laws, regulations, governments or government agencies, transport delays, fire, flood, act of God, breakdown of plant, transport delays, shortages or unavailability of materials or labour, storm or tempest, theft, vandalism, riots, civil commotions or accidents of any kind.

  • Event Participant Obligations

    During an MPAQ event or webinar, you must comply with the following obligations:

    • you must conduct yourself in a manner that takes due care and regard of your own safety. In addition, you acknowledge and agree that you are entirely liable and responsible for the safety of any attendee;
    • you must procure that any attendee takes care for their own safety and welfare in travelling to the event, during the event, and when leaving the event
    • you must comply with the Law and act in accordance with the requirements of all relevant Government Authorities;
    • you must comply with any relevant policy, guideline, rule, Law or regulation associated with the place where the event is held;
    • you must comply with all directions given by MPAQ staff;
    • you must comply with any direction concerning the site of the event given by that site’s proprietor (or on the site’s proprietor’s behalf);
    • you must not engage in any conduct that is dangerous to any other person or event participant;
    • you must not engage in conduct which might be a nuisance to other event participants / their attendees or persons in property adjoining the site at which the event is being held;
    • you must ensure that any electronic system that is used to access a Webinar has appropriate and current security software;
    • you must not engage in any conduct or use language which is likely to offend, insult, humiliate, disparage or vilify any reasonable person on the basis of gender, race, religion, culture, colour, descent, country of origin or disability; and
    • you and your attendee(s) must not consume an amount of alcohol or any other drug in an amount that would make it difficult for you or the attendee to comply with the obligations in this clause.
  • Removal / Ejection of an Attendee

    You acknowledge and agree that if you or an attendee breaches any aspect of these Event Terms and Conditions, then MPAQ may remove that attendee from the event or webinar.

    You acknowledge and agree that despite any provision in these Terms and Conditions to the contrary, if MPAQ ejects you or an attendee as contemplated above, then:

    • MPAQ is not obligated to provide any refund of any Fee that may have been paid by you to MPAQ; and
    • any Fee (or part thereof) with respect to the event and / or webinar that was outstanding at the time of the ejection of you or the attendee remains due and owing to MPAQ.
  • Limitation of Liability and Indemnity

    Limitation of Liability

    The event attendee acknowledges and agrees that attendance at:

    • an event may expose the event participant and any attendees to personal injury and loss to their personal property / belongings. The event participant and any attendees accept those risks, and participate in an event at their own risk;
    • a webinar may expose the event participant’s electronic systems to, without limitation, risk of infection with viruses, malicious software, hacking, identity theft, monetary loss and other such incidents that may give rise to loss.

    The event atendee releases MPAQ, its officers, employees, agents, or related bodies from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from or are in any way connected with an event or a webinar or any matter set out in these Event Terms and Conditions.

    The event atendee agrees and acknowledges that prior, during or after an event or webinar, MPAQ may provide to the event atendee, a gift (including perishable and non-perishable foods, beverages and goods), sample, party favour, voucher, or other thing at no cost to the Event Participant and an Attendee (Gift). The event atendee:

    • acknowledges and agrees that MPAQ does not warrant the fitness, quality or safety of the Gift;
    • accepts any Gift at its own risk such that any risk of injury, damage, and / or loss (including risk of injury, damage, and /or loss to an Attendee) is entirely the event atendee’s risk; and
    • releases MPAQ, its officers, employees, agents, or related bodies from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from or that are in any way connected with the Gift.

    Indemnity

    The event atendee agrees to wholly indemnify MPAQ, its officers, employees, agents, or related bodies from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from, or are in any way connected with, an event, webinar, or any matter set out in these Event Terms and Conditions.

    The event atendee agrees to wholly indemnify MPAQ, its officers, employees, agents, or related bodies from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from, or are in any way connected with the Gift.

    No other indemnity or provision in these Event Terms and Conditions is to be construed as taking away or diminishing the extent of the indemnities set out in this clause.

  • Food Requirements

    This clause applies only where an event or a webinar includes the provision of food as part of the event or webinar.

    Notice of Food Allergies

    MPAQ will not cater for any Food Allergy unless informed in writing at least 5 Business Days prior to any event, unless stated otherwise on the event information.  Any notice of a Food Allergy must be sent to events@mpaq.com.au.

    The event attendee acknowledges and agrees that MPAQ may not be able to secure alternative catering arrangements even where notice of a Food Allergy has been made by the event attendee in accordance with the terms of these Event Terms and Conditions.

    The event attendee acknowledges and agrees that whether it has notified MPAQ of any Food Allergy or not, the event attendee will be completely and entirely responsible for assessing for itself the safety of any Food acquired in and around the location of the event or webinar.

    The event attendee acknowledges and agrees that where a Gift is in the form of Food, MPAQ will not cater the Gift for any Food Allergy.

    Release and indemnity from incidents arising from and associated with Food Allergies

    The event attendee release and forever discharges MPAQ from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from, or are in any way connected with, a Food Allergy.

    The event attendee indemnifies MPAQ from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from, or are in any way connected with, a Food Allergy (including but not limited to claims made against MPAQ by an event attendee).

  • Image Release

    By attending an MPAQ event or webinar, as a presenter, partner, ticket holder, or as a guest:

    • You consent to the recording and perpetual use of your voice, image or likeness in any form or medium, including as part of any broadcast, or recording of the event or webinar and for any other commercial purposes (including advertising and promotional materials) without compensation.
    • You will procure that the attendees agree to the recording and perpetual use of their voice, image or likeness in any form or medium, including as part of any broadcast, or recording of the event or webinar and for any other commercial purposes (including advertising and promotional materials) without compensation.
    • You indemnify MPAQ from any Claim, demands, losses, damages, penalties, proceedings, compensation, costs, charges, expenses and liabilities, which arise from, or are in any way connected with the matters set out in the Image Release clause of these Events Terms and Conditions.
