Employment Contracts

An employment contract is a legally binding document that outlines the terms and conditions of employment and details the specific provisions agreed to between the employer and the employee.

Ideally an employment contract should be provided before the employment relationship commences to ensure that any negotiations are detailed in the employment contract and then both the employer and employee sign the contract to mutually agree to the terms and conditions of employment.

  • Casual to Full-time Conversion

A true casual is an employee who works irregular hours with no ongoing basis for employment.

However, if a casual employee does work regular and systematic hours with an ongoing expectation of employment, the employee can elect to be converted to a full-time or part-time permanent employee (depending on the regular hours the employee has been working) after six months (for those under the Plumbing and Fire Sprinklers Award) or twelve months (for those under the Clerks-Private Sector Award) of employment. Given this, employers should carefully consider whether casual employment is the suitable employment basis.

These documents are invaluable to your business because failure to use a contract leads to difficulty in enforcing your rights and protecting yourself against a claim against your business.
